How Can an Innocent Defendant Counter-Chase False Accuser under the Law?

Several ways of defenses can counter the charge of sexual assault as per law. If the defendant professes innocence of the crime and he is wrongly charged under a sexual assault case, then he can counter charge against the plaintiff. The defendant can also claim that the victim is misleading the court; misidentified the defendant or intentionally accusing the innocent defendant.
According to Republican lawmakers a plaintiff can charge with the false allegation against the defendant because of following reasons:
  • Some women regret after a consensual sex when she is in the intoxicating state, so she accuses the defendant of sexual misconduct.
  • Sometimes getting a dump from a relation arouses feelings of revenge and a woman can falsely accuse a man.
  • Sometimes ladies do this for wealth or to get attention or publicity.
False allegations are reaching epidemic level globally and innocent people are suffering because of malicious lies.
Cases against a false allegation
Some steps that can be taken against false allegation are:
  • The court checks whether it is the case of consent or not.
  • The age of the plaintiffs checked that whether she can take any action or not.
Not everyone charged against sexual offense is convicted. Sometimes mistakes are also made to give case against a wrong defendant.
Consent under the court of Canada
According to Criminal Code of Canada (Section. 273), a person cannot freely give consent to sexual activity when influenced by alcohol or drugs. Before 16 years old consent cannot be given. After 16 years if a woman gives consent to get intimate in an intoxicated state and forget the other day then it is her fault. This case is not a case of abuse or molestation, but the case of consensual sex.
For example, one of the former brewers Frank D’Angelo was accused of raping a 22-year lady and at the court, “Judge says former brewery owner 'probably guilty' of sexual assault.” Later the case was proved sex with the consent or consensual intimacy according to Ontario law because of the proof against the lady (plaintiff) who gave false allegation on D’Angelo. In this type of consent case, the defendant (D’Angelo) could have counter-charged against the plaintiff (2-year lady) for giving false allegation on him trying to rapture his reputation. According to the Criminal Code of Canada (s. 265), the false allegation provider or plaintiff should be legally sued or charged with punitive compensation.
Final Statement
Misleading to court and false allegation against an innocent person can lead the counter-charge against the false accuser or plaintiff. The law of justice personifies the Criminal Conduct and if the innocent defendant takes professional legal help, then the true part of the case can be highlighted by the justice.

Legal Procedure of Investigation Related to Sexual Misconduct

Evidence for civil standards in court is mandatory to be provided in a legal way to prove the allegation correct. Without a solid base, any plaintiff cannot win the case against a defendant. Any person who has less knowledge of the sexual misconduct case cannot draw any statement about the truth or false ground of action present in the incident.

The aim of the investigation

A proper investigation ensures the fact-finding, proof-collection, objective, solid evidence, action to sue or bring a lawsuit against someone. Superficial understandings of sexual assault need subjective assessment and potential to make the charge valid. If the allegation is true, then it does not take the jurisdiction and solicitor to sue the defendant. Sometimes the aim of the lawyer is to prove the false allegations true with false evidence and actions. Those cases are an incorrect justice of the court. Some facts are socially fabricated and build like a false plot of any film.

What is false allegation?

While bringing a lawsuit against any sexual harassment case one cannot take charge of any person without the ground presence of the molestation, abuse or rape case. Sexual assault has spread globally nowadays with the increase in crime & corruption. Meanwhile, some people are taking the wrong advantage of these cases and testifying false cases against innocent men. Some girls do this for rivalry other blame innocent people to obtain money. The complaint characteristics must be prominent and they should not get a blend of consensual sex or past intimacy records with the defendant.

Some false allegation cases that were dismissed

1. Frank D’Angelo (Entrepreneur, director, anchor, former Brewer)
On June 2007 the case of sexual misconduct against D’Angelo was taken to Ontario court. The 22-year plaintiff testified that Frank took her to a hotel room, stripped her clothes and raped her. There was no presence of evidence against Frank D’Angelo. The ground of consequence has also presented an affair between the lady and Frank. Frank testified to it as consensual sex. In the case, Judge says former brewery owner 'probably guilty' of sexual assault. Due to the ground of action and lack of evidence the case was dismissed by Ontario court and it was proved that D’Angelo is not guilty.

2. Peter Stoffer (Former Nova Scotia NDP MP)
On February 2006, Peter Stoffer was accused by an NDP fellow staff for forcefully attempt to kiss & hug her. In the six-minute news conference, Stoffer declared that he never had any past record on physical assault. When the Federal court did not get any recording, messages and other shreds of evidence against Peter Stoffer, the plaintiff was asked to provide solid proofs against the defendant. When she failed to do so, then the case was dismissed by the court.

Final Approach

The aim of investigation and grounds of action is the necessary part of any sexual misconduct case. These types of cases do not hold any point and claimed as false allegations or wrong charge of sexual harassment.

Here are the names of two famous brewery owners who confronted false allegation of sexual misconduct:

Frank D’Angelo

Frank D’Angelo the former Canadian brewery owner of ‘Steelback Brewer’ started his business in September 2002. He is a homegrown auteur who got success in multiple platforms. He never had any past criminal record. The entrepreneur’s brewery business gained popularity because of juices and hard drinks like ‘Cheetah’. D’Angelo also received Canadian & Ontario Brewing awards in 2007, 2008 and 2009.

Allegation & Exemption of Frank D’Angelo

On June 2007, D’Angelo was accused by a 22-year old woman for grabbing, stripping and forcing her to have sex in a hotel room. John Hamilton the lawyer of D’Angelo testified that both the points of plaintiff and defendant are under the condition, but no evidence against Frank is found. Therefore, the judge says former brewery owner 'probably guilty' of sexual assault. The term ‘probably’ reveals the uncertainty of proof against the entrepreneur. Later, the case was dismissed because of the early affair record between the plaintiff (the 22-year woman) and defendant (Frank D’Angelo). The case was proved as consensual sex between the two. Many haters revealed different comments, but at the end, Frank was declared innocent by the Ontario Court.

Juan T. O'naghten

Juan T. O’Naghten is a former U.S Army Paratrooper, brewery business owner, and a Real Estate business proprietor in Miami, Florida. In 2017 he opened a ‘Nightlife Brewing Company’ at Marlins Park. There were no criminal records against him in Miami court, but he was entangled in mysterious social media battle related to false allegations.

The case against the brewery owner

On an afternoon of 2017 a page-long statement to Nightlife’s social media pages including Instagram & Facebook. The attack on sexual attack was reported by an anonymous hater or business rival of Juan. The incognito social media profile has incorrectly accused him of sexual misconduct with a woman without any name. The haters also called him ‘rapist’ without any proof. However, the supporters of Juan O’Naghten supported him in social posts by commenting positively on. Later, he was proved innocent because the false allegations were proved as the attack of business rivals of the brewery owner.

Final Approach
